Official Rules
Participation in the Contest constitutes full and unconditional agreement and acceptance of these Contest Rules, which are final on all matters relating to the Contest.
ELIGIBILITY/HOW TO ENTER
No Purchase Necessary. To enter the Contest, visit www.raptors.com/contests (the “Contest Website”) between 12:01 pm Eastern Time (“ET”) on Wednesday, February 20, 2008 and 11:59 am ET on Monday, March 17th, 2008 (the “Contest Period”) to nominate a coach (the ‘Nominee”) of:
who in your belief demonstrates passion, dedication and spirit within the basketball community. Each basketball team referred to above shall hereinafter be referred to as the “Nominees’ Team” To nominate the Nominee, you must fully complete the online entry ballot available on the Contest Website (including telling us, in 100 words or less how the Nominee demonstrates passion, dedication and spirit within the basketball community) and submit the ballot such that it is received prior to 11:59 am (Toronto time) on Monday March 17 th 2008 (the “Contest Closing Date”).
In order for a Nominee to be eligible to win a prize, the person submitting the nomination (the “Entrant”) and Nominee must each be 18 years of age or older, and be legal residents of Ontario living within a 75 mile radius of the city of Toronto. In addition, Entrants must be either (i) the coach of, or (ii) a parent/legal guardian of a player on, an active Greater Toronto Area high school basketball or Greater Toronto Area basketball team. In addition, neither Entrants nor their Nominees may be employees or their immediate families (or persons with whom they are domiciled) of Maple Leaf Sports & Entertainment Ltd. (“MLSE”), The Home Depot Canada (collectively, the “Contest Sponsors”), the National Basketball Association, its member teams, NBA Properties, Inc. or their respective parents, subsidiaries, affiliates, directors, officers, governors, employees and agents. Immediate family includes the husband, wife, son, daughter, brother, sister, mother, or father of any individual.
Only one nomination may be submitted per Entrant. Duplicates and reproductions will be void. Entrants may not submit their own names as Nominees; any such nominations will be void. No prizes will be awarded to any Entrants. Nominees are each eligible to win only one (1) prize, regardless of the number of nominations he/she receives.
All entries will become the property of the Contest Sponsors and will not be returned. Contest Sponsors will not be responsible for entries which are incomplete, illegible, garbled, lost, late or fraudulent, which will be void. Proof of submission does not constitute proof of receipt.
PRIZES
There are a total of twenty (20) prizes available to be won in this Contest.
Each Prize consists of:
Odds of a Nominee winning a prize will depend on the number of eligible entries received within the Contest Period and the strength of the nomination, as judged against the criteria set out below.
Date and time of coaching clinic will be determined by Contest Sponsors in their sole discretion. All incidental costs and expenses not specifically referred to as being included in the prize, including, but not limited to, transportation to and from Air Canada Centre, food, beverages, souvenir items, etc. shall be the responsibility of the selected Nominees. Prizes must be accepted as awarded and cannot be exchanged for cash or otherwise, except at the sole discretion of Contest Sponsors.
NOMINEE SELECTION
Nominations will be reviewed by a selection committee consisting of representatives from the Contest Sponsors. The deservedness of the Nominee to win will be judged based on the following criteria on a score between 1 and 10 for each listed criteria (with 1 being the lowest score and 10 being the highest score), each weighted equally (except as indicated below in the case of a tie):
All claims made in the submitted nominations are subject to verification at the Contest Sponsors’ sole discretion, and any falsified, fraudulent or misleading nominations will be void. All decisions of the Contest judges are final and binding, and not subject to appeal. In the unlikely event of a tie between Nominees’ scores, the Nominee with the highest score in the “Inspiration” category will be given the higher score. Contest Sponsors reserve the right not to award all prizes in the event that an insufficient number of entries are received.
Selected Nominees will be notified by either telephone or email (depending on the Nominee contact information provided by the Entrant on the online entry form) between Wednesday March 19 th, 2008 and Friday March 28 th, 2008.
Before being declared a winner, each selected Nominee will be required to sign a Declaration and Release of Liability Form in which they each agree, among other things, (a) that their acceptance of any prize does not violate any restrictions imposed by the school, school board, or basketball association in which the selected Nominee is employed or is affiliated with; (b) that, if declared a winner, they consent to have their respective names appear in a publicly distributed list of Contest winners; and (c) to hold harmless and indemnify the Contest Sponsors and the National Basketball Association, and its member teams, NBA Properties, Inc. and each of their respective parents, subsidiaries, affiliates, directors, officers, governors, employees and agents (collectively with the Contest Sponsors the “Released Parties”) against any and all liability, damages or causes of action (however caused, named or described) with respect to or arising out of either: (i) participation in the Contest; and (ii) acceptance and use of the prizes awarded therein; and (iii) the administration of the Contest and distribution of the prizes awarded therein.
PERSONAL INFORMATION
By entering the Contest, each Entrant consents to the use and disclosure of his/her personal information by the Contest Sponsors and their authorized agents for the purposes of administering the Contest and, if the Entrant’s Nominee is declared a winner, consents to the use of his or her name, address (city/province), biographical information, photograph or other likeness without compensation in any publicity or promotional purposes carried out by the above parties. Entrants may be required to sign a document to this effect.
By nominating a Nominee, the Entrant represents and warrants that he or she has the consent of the Nominee to submit personal information about the Nominee to the Contest Sponsors and their authorized agents (including but not limited to the Nominee’s name and school at which he or she is a coach) for the purposes of administering this Contest and fulfilling prizes.
By accepting a prize, Nominees consent to the use of his or her name, address (city/province/school), biographical information, photograph or other likeness, without compensation in any publicity or promotional purposes carried out by the Contest Sponsors and their authorized agents.
GENERAL RULES
This Contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. All decisions of the Contest Sponsors are final and binding in all matters relating to this Contest and are not subject to appeal or review.
By entering the Contest, Entrants (and by accepting a Prize, selected Nominees) agree to hold harmless the Released Parties against any and all liability, damages or causes of action (however named or described) with respect to or arising out of: (i) participation in the Contest, (ii) the receipt or use of the prizes awarded therein; and (iii) the administration of the Contest and distribution of the prizes awarded therein.
Prize winner(s) must be able to attend on the date and time designated by the Contest Sponsors or such prize will be forfeited and may be awarded to an alternate winner.
The Contest Sponsors reserve the right to substitute prizes of equal or greater value and/or to terminate, modify or withdraw this Contest, in whole or in part \at any time, without prior notice for any reason including, but not limited to, if viruses, bugs, tampering or other causes beyond the Contest Sponsors’ control affect the administration, security, fairness or proper play or conduct of the Contest. In the event a substitute prize is awarded, such prize must be accepted as awarded and cannot be exchanged for cash or otherwise. Further, the Contest Sponsors reserve the right to disqualify any person and void any entries of that person who it believes has tampered with the entry process or any other component of the Contest, whose conduct or action affects the administration, security or fairness, integrity or proper conduct of the Contest, or who fails to meet or abide by the Contest Rules and conditions.
The Contest Sponsors do not assume any responsibility for tampering, theft, defects, viruses, human errors including negligence, deletions, technical or telephone, computer line, network, server, access providers, computer equipment or software problems, undeliverable messages, computer errors, lost, misdirected, late or incomplete entries or inaccurate capture of information or any online difficulties that may result in damage or malfunction of the computer or the failure of the Contest Sponsors to process any entry and otherwise award any prize. Nor is responsibility assumed for printing errors appearing in these rules or related Contest materials. In addition, the Contest Sponsors will not assume any responsibility of any nature whatsoever in all cases where their inability to hold the Contest or to remit the prizes to the winners results from a cause beyond their control, including Acts of God, war or terrorism, weather conditions, strike, lock-out or other labour dispute. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should an attempt be made, the Contest Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
